1. PLEASE NOTE: There are inherent dangers associated with this route such as moving vehicles, wild animals, unexpected wildfires and/or adverse weather conditions. The permit holder and all visitors to Elgin Valley Trails, Grabouw Forest Trails, Oak Valley Trails, Paul Cluver Trails and the land areas where activities take place, theArea”, acknowledge and agree that they accept the presence of the aforesaid inherent risks and the like thereof in the Area, and agree that neither Elgin Valley Trails, Grabouw Forest Trails (incorporating trails on Fruitways Farms), Oak Valley Trails, Paul Cluver Trails nor the owner/s of the Area, shall be liable for any loss or damage any permit holders and visitors may sustain as a result of them being present on Elgin Valley Trails (which includes Grabouw Forest Trails and Oak Valley Trails), Paul Cluver Trails and in the Area.

2. Access is restricted between sunrise and sunset on the date/s of permit validity, unless authorised for camping, overnight hiking or as specified under special conditions in this permit.

3. Notice boards and any symbol signs on Elgin Valley Trails and Area must be obeyed.

4. Elgin Valley Trails, the Area or parts thereof may be closed to public access for specific periods during which time entry is prohibited to permit holders and visitors.

5. The lighting of fires in the Area is prohibited, except in places specifically provided for this purpose. PLEASE NOTE: The lighting of fires in designated fireplaces may be prohibited for specified periods. Fires may not be left unattended and must be fully extinguished after use.

6. No litter, refuse or empty containers shall be discarded on Elgin Valley Trails and in the Area. Please make use of the refuse containers specifically provided for this purpose.

7. No person may damage, remove or interfere with any beacon, boundary marker, fence, notice board or other structure on Elgin Valley Trails and in the Area.

8. No person may interfere with work activities on either Elgin Valley Trails or in the Area and no unauthorised access is allowed to any part of Elgin Valley Trails or the Area where personnel or equipment are at work.

9. All wildlife and vegetation is protected and may not be removed from Elgin Valley Trails and the Area.

10. Plants, trees, rocks or works on Elgin Valley Trails and the Area may not be removed, damaged by carving, scratching or marking in any way.

11. The feeding of wildlife is prohibited and no hunting is allowed on Elgin Valley Trails and in the Area.

13. Dogs with owners using the Grabouw Forest Trails must be on a lead at all times. Owners taking dogs off their leads do so at their own risk and will be liable for any damage or loss caused by such dogs. Horse riding is permitted only on specific, demarcated horse trails.

14. Swimming and fishing are only permitted where designated by means of notice boards.

15. The unauthorised launching or landing of hang-gliders and paragliders is prohibited on Elgin Valley Trails and the Area unless this takes place where specifically designated for this purpose.

16. Smoking is not permitted in any plantation or fynbos area.

17. Visitors, including the permit holder, shall be liable for any damage caused to Elgin Valley Trails and the Area as a result of any act or omissions on their/his/her part.

18. Each visitor, including the permit holder, shall indemnify Elgin Valley Trails (which includes Grabouw Forest Trails (incorporating trails on Fruitways Farms) and Oak Valley Trails), Paul Cluver Trails and the owner/s of the Area as well as its employees, shareholders, subsidiaries and/or independent contractors and shall keep them indemnified against all damage, costs (including legal costs), losses and claims for injuries, or loss of life which he or she may sustain, or which may arise out of or as a consequence of he or she being present on Elgin Valley Trails, Grabouw Forest Trails, Oak Valley Trails, Paul Cluver Trails and the Area.

19. Each visitor, including the permit holder, confirms that minor/s who enter the Elgin Valley Trails and Area with him or her, do so at such visitors’ and / or permit holder’s own risk and he or she indemnifies, holds harmless and absolves Elgin Valley Trails and the owner/s of the Area as well as its employees, shareholders, subsidiaries and/or independent contractors from any damage, costs (including legal costs), losses and claims for injuries, or loss of life which may arise out of the minor/s being present on Elgin Grabouw Trails and the Area, as well as any damage, loss or harm suffered by such minor. Each visitor and / or permit holder warrants that they have the written permission of both parents / guardians of minor/s in their charge and indemnify Elgin Valley Trails and the owner/s of the Area against any damages, loss or harm suffered by them as a result of this warranty not being correct.

20. Special conditions, licenses or fees may be applicable to specific activities, places, times and events.

21. This permit and any associated proof of legibility must be produced and shown to any authorised person on request.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION AND WARNING OF RISK AGREEMENT, I DO FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS AGREEMENT AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I UNDERSTAND THERE ARE NO REFUNDS.
